These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly, made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the "website") and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement). These pages, the content and infrastructure of these pages, and the online reservation / booking service provided on these pages and through the website (the "service") are owned, operated and provided by BookingHawk.com and are provided for your personal, non-commercial use only, subject to the terms and conditions set out below.
Through the website we provide an online platform through which users can advertise their business, and through which visitors to the website can make such reservations. By making a reservation through BookingHawk.com, you enter into a direct (legally binding) contractual relationship with the provider at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the business, transmitting the details of your reservation to the relevant provider and sending you a confirmation email for and on behalf of the provider. When rendering our services, the information that we disclose is based on the information provided to us by providers. As such, the providers are given access to an extranet through which they are fully responsible for updating all rates, availability and other information which is displayed on our website. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each provider remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any bookable service made available.
If applicable and available, certain providers offer the opportunity for reservations to be paid (wholly or partly and as required under the payment policy of the provider) to the provider during the reservation process by means of secure online payment (all to the extent offered and supported by your bank). Payment is safely processed from your credit/debit card or bank account to the bank account of the service provider through a third party payment processor. In the event of credit card fraud or unauthorised use of your credit card by third parties, most banks and credit card companies bear the risk and cover all the charges resulting from such fraud or misuse, which may sometimes be subject to a deductible (usually set at EUR 50 (or the equivalent in your local currency)). In the event that your credit card company or bank charges the deductible from you because of unauthorised transactions resulting from a reservation made on our website, we will pay you this deductible, up to an aggregate amount of EUR 50 (or the equivalent in your local currency). In order to indemnify you, please make sure that you report this fraud to your credit card provider (in accordance with its reporting rules and procedures) and contact us immediately by email at BookingHawk.com. Com. Please state 'credit card fraud' in the subject line of your email and provide us with evidence of the charged deductible (e.g. policy of the credit card company). This indemnification only applies to credit card reservations made using BookingHawk.com.com's secure server and the unauthorised use of your credit card resulted through our default or negligence and through no fault of your own while using the secure server.
By making a reservation with a provider, you accept and agree to the relevant cancellation and no-show policy of that service provider, and to any additional (delivery) terms and conditions of the provider that may apply to your reservation. If you wish to review, adjust or cancel your reservation, please revert to the confirmation email and follow the instructions therein.. We recommend that you read the cancellation, (pre)payment and no-show policy of the provider carefully prior to making your reservation and remember to make further payments on time as may be required for the relevant reservation.
BookingHawk.com.com does not own or endorse the photos/images that are uploaded. The truthfulness, validity and right to use of all photos/images is assumed by the person who uploaded the photo, and is not the responsibility of BookingHawk.com.com. BookingHawk.com.com disclaims all responsibility and liability for the pictures posted. The person who uploaded the photo warrants that the photos/images shall not contain any viruses, Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and does not infringe any third party (intellectual property right, copyright or privacy) rights. Any photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by BookingHawk.com.com at any time and without prior notice.
The booking contract is between the business owner and the booking party. BookingHawk.com is not responsible for double bookings, cancellations or refund agreements made outside of the scope of this application.
You must be the required legal age to book services or appointments using BookingHawk.com which are subject to age laws.
If you have any issues or problem creating a booking, you agree to attempt the resolution of the matter directly with the business / service for which you are trying to book an appointment. .
BookingHawk.com is not responsible for any damages or missed appointments as a result of a business incorrectly geo-locating their location.
BookingHawk.com reserve the right to cancel any booking made using our software without any fees or penalties. In the event of such an occurrence BookingHawk.com will decide on a case by case basis if a refund should be granted.
All payments are restricted to the terms and privacy of our Payment Partner Stripe which can be found on their website.
BookingHawk.com is not responsible for any misrepresentation of a business or service listed on BookingHawk.com. If a business / service is not as described, a customer should let BookingHawk.com know via a written complaint. Upon receipt of such a correspondence, BookingHawk.com will aim to inform the business / user owner of the complaint. What happens as a result of the complaint is up to BookingHawk.com.
If you are not the holder of the Credit Card which is being used to make a booking you must gain the expressed permission of the card holder before charging any bookings to it.
You must ensure that you enter your correct contact details when making a booking. If the business owner cannot get in touch with you via phone or email they have the right no to hold your booking.
By completing a booking on BookingHawk.com, you are agreeing that you have read and accepted the terms and conditions as well as the privacy statement provided on this website.
Prices listed may be subject to certain terms and conditions as set out by the business with which you are booking. Please be aware that the conditions will be listed on your booking confirmation page as well as your booking email. The conditions are binding
BookingHawk.com may not be held liable if any availability alerts fail to send.
By signing up to an alert, you agree to receive alerts until the expiry time of the alert which you created.
When booking multiple assets (assets referring to the item/service that the business your are booking from is offering via BookingHawk.com), if you are required to pay a booking deposit for any of the assets, this deposit is spread against all assets which you are booking. This means that you will be paying a booking deposit on assets for which a booking deposit would otherwise not be required.
When refunds are issued, the transaction commission, charged by our payment partner Stripe may not refunded. Whether or not will depend on the setup of the business which you are booking. It will be stated in the cancellation policy which is displayed prior to, and after booking whether or not it will be returned. Stripe commission rates can be seen on their website.
When you create a client account on BookingHawk.com, you are agreeing to the terms of service of BookingHawk.com
When you make a booking whilst logged in to your client account on BookingHawk.com, you are agreeing to the terms of service of the business/service which you are booking.
When you make a booking whilst logged in to your client account on BookingHawk.com, you must agree to the data usage policy of the business with whom you are making the booking. When you agree to it the first time, you will no longer be asked if you agree to it for your subsequent bookings. The exception to this is when the business change their data usage policy. You will then be asked if you agree to it before booking.
We use session cookies to enable you to reserve and subsequently book/purchase items via our site. A cookie is a small piece of data in the form of a text file that may be stored on your computer or mobile device having visited a website. It allows a website "remember" your actions or preferences over a length of time.
The expiry date of a credit bundle will be at the exact time of the purchase of the bundle, X days in the future, where X is the "Number of Days" after the bundle is purchased. For example, if a Credit Bundle with a validity period of 10 days is purchased on October 1st at 9:56AM , the client can use the Bundle to book services that start up to October 11th at 9:56AM. ie, 24-hours multiplied by the number of days of validity is the number of hours after purchase that the Credit Bundle expires.

BookingHawk.com reserves the right to cancel your membership if we have reason to believe that you are using our software in order to fully or partially facilitate illegal activities.
BookingHawk.com reserves the right to withhold any balance outstanding at the end of a payment cycle for any outstanding fees owed by a business.
BookingHawk.com retains all advertising rights for every page within the BookingHawk.com domain name and application.
BookingHawk.com will endeavour to protect your identity and information and that of your customers. Although every reasonable precaution has been taken to protect this information, BookingHawk.com will not be held accountable in the event of a security breach.
BookingHawk.com is not responsible for any damages or missed appointments as a result of a business incorrectly geo-locating their location.
BookingHawk.com is not responsible for any private notes being leaked to customers of your business.
BookingHawk.com aims for 100% (twenty-four hour, seven days-a-week) availability. However, it is possible that from time to time, BookingHawk.com will not be on line or available. In such circumstances, BookingHawk.com is not responsible for any loss of revenue.
BookingHawk.com is not responsible for any loss of information should the system meet any unforeseen circumstances.
If BookingHawk.com ceases to operate, there is no obligation on BookingHawk.com to inform users of loss of service.
Once you complete registration of your business on BookingHawk.com, you will be required to verify your identity before you can begin taking bookings. BookingHawk.com will require a copy of your passport or driving license as well as a copy of a document proving your address. Failure to provide these within 7 days will see your BookingHawk.com account suspended.

BookingHawk.com reserves the right to cancel, delete and or close the account of any registered business if BookingHawk.com deem that the business has become dormant. To become dormant, BookingHawk.com will suspect that the registration of said business was carried out for curioustity purposes only. BookingHawk.com will consider an account to be dormant if the owner of a registered business does not verify their business or respond to BookingHawk.com communications. .
You must be the required legal age to add a business or service to BookingHawk.com that is subject to age laws.
You must gain the card holders expressed permission in order to take Credit Card payments from their Credit Card.
Any customer or business data contained with BookingHawk.com as a result of your business operations using BookingHawk.com will become the property of BookingHawk.com once your account closes. BookingHawk.com is not obliged to give you access to the data when your account is not active.
You must be the owner of the business / service or have the written and verified permission of the owner to use BookingHawk.com for the business / service for which you are using BookingHawk.com.
If you are found to be misrepresenting any of your goods or services through BookingHawk.com, BookingHawk.com reserve the right to cancel your membership and seek costs for any damages claimed against BookingHawk.com.

Upon registration, BookingHawk.com will create a customer entity with our payment partners Stripe on their system. For this, we will need to share your email address. .
If at any stage you choose to setup automatic payments or have BookingHawk.com remember your card details, these details will be stored by Stripe on their systems and will therefore be their responsibility.
BookingHawk.com is not responsible for any breach of security at Stripe and the resulting leak or loss of personal or private information. By agreeing to these terms and conditions, you are accepting this.
BookingHawk.com may suspend your account and or cancel your membership if it deems a booking question(s) as inappropriate.
All payments made to BookingHawk.com, whether for SMS units or for service periods are non transferable and non refundable.
BookingHawk.com is not responsible for any ill effects caused by performance lag caused due to network connectivity issues.
There are no SMS units or credits included in the free trial period.
BookingHawk.com submits a sitemap file to Google. This is an xml file which informs Google of all the pages within BookingHawk.com. This file is used by Google for the purposes of dislaying search results. By offering your services and or events on BookingHawk.com, you consent to the submission of this file to Google. The file can be seen at https://bookinghawk.com/sitemap/sitemap.xml
BookingHawk.com reserves the right to suspend accounts that have gone 14 days or more overdue for payment. BookingHawk.com reserves the right to do so without providing the business with any notice period.
BookingHawk.com reserves the right to delete in their entirety, any accounts and their associated data that have gone 14 days or more overdue for payment. BookingHawk.com reserves the right to do so without providing the business with any notice period.
BookingHawk.com has been designed and built to never charge for a non delivered SMS. If BookingHawk.com is found to have done so, the amount of SMS units charged to send the unsuccessful SMS will be reapplied to the business account. No further renumeration or compensation will be offered even if it results in a missed appointment.
Although every reasonable action will be taken to ensure that BookingHawk.com is available 100% of the time, from time to time it may need to be taken offline for upgrades or maintenance. Where possible, this will be done during off peak times. However, in some cases, this will not be possible and access to the system may be compromised during peak times. Where possible, BookingHawk.com will inform Business / Service owners in advance of any down time.
You agree that all payments collected on behalf of your business/service are paid into the Stripe account of BookingHawk.com. From there they are transferred to a bank account associated with BookinHawk.com before being moved to your bank account.
By uploading photos/images onto our system you certify, warrant and agree that you own the copyright to the photos/images and that you agree that BookingHawk.com may use the uploaded photos/images on its (mobile) website and app, and in (online/offline) promotional materials and publications and as BookingHawk.com at its discretion sees fit. By uploading these photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, service owners) due to BookingHawk.com.com publishing and using these photos/images. BookingHawk.com.com does not own or endorse the photos/images that are uploaded. In the event of this happening, BookingHawk.com is no longer responsible for the integrity of your data, timetables or security of your sensitive customer information.
BookingHawk.com is happy for you to delegate the operation of your non-authenticated business page to a virtual secretary or third party service. This does not require or include the sharing of any of your login details with said service. By 'non-authenticated business page', BookingHawk.com is referring to the page of your business which can be viewed without logging in or authenticating.
Should your non-authenticated business page be accessed or operated by a third party with your permission, BookingHawk.com is not responsible for any mistakes or errors made by the third party during the operation of your non-authenticated business page.
By offering events / products /services for online booking on BookingHawk.com, you are agreeing that you have read and accepted the terms and conditions as well as the privacy statement provided on this website.
Information which you store about your client(s) in the BookingHawk.com system must be done so with the expressed and explicit permission. For example, should you wish to record data about a client using the notes feature of BookingHawk.com, you must ensure that your client is aware that you are doing so.
Any information stored within the BookingHawk.com system, about your clients, may not be used for any other reason other than to provide the service which your client hired you for. You may not farm, sell or make public any such information without the expressed and explicit permission of your client and of BookingHawk.com.
BookingHawk.com may not be held liable for loss of earnings if any availability alerts fail to send.
If you are uploading the personal details or schedule of any of your staff members, you must have first attained their explicit permission to do so.
Automatic renewals and payments of subscriptions will be made at the then current price.
Integrating your BookingHawk.com account with Google Calendar grants access to BookingHawk.com to read events, their descriptions, their start and end times their subjects and all other associated data on the events. Although BookingHawk.com can access this information, it only reads the start and end times of the events.
When refunds are issued, the transaction commission, charged by our payment partner Stripe may not refunded. Whether or not will depend on the setup of your business and whether or not you have connected your own Stripe account. Should you connect your own Stripe account, where applicable, refunds are issued for 100% of the amount the user paid. This means that you will be nett down on the transaction to the amount of Stripe transaction charge on the initial payment. Stripe commission rates can be seen on their website.
With BookingHawk.com, booking/purchase is a two-step process. The first step is that the payment is taken from the clients card by Stripe. When Stripe indicates that the payment was successful, BookingHawk.com saves the details and sends confirmation emails etc. At the point of Stripe notifying us the payment succeeded, the process can encounter problems. When such failures happen, the payment succeeds, but the booking/purchase fails. The user is informed that something went wrong and they do not get a confirmation email. They are prompted to try again. At this point, there is a payment in Stripe, but no corresponding/matching booking/purchase in BookingHawk.com. This scenario is rare but it is one we must live with - from time to time two software systems communicating with each other will encounter issues. Within a short period of time (typically three hours), an auditing job in BookingHawk.com identifies the payment with no corresponding booking/purchase and issues a refund. In many cases, because the refund happens so soon after the payment, what will happen is that the transaction disappears entirely from the clients bank statement as if it never happened. The important point to understand here is that when the client does not show in your BookingHawk.com account, then the booking/purchase did not succeed and if any payment was taken, it will be refunded. If you have any questions about an individual booking/purchase, please feel free to contact us with the details and we will investigate and clarify.
Credit Bundles AKA Class Passes are the term used to denote that a client can pay a group of your services in one transaction. If you enable this feature, the client may then redeem these credits when booking your services.
When you change your data usage policy in the system, your customers acceptance of it will automatically be re-required on their next booking/purchase. You are responsible for keeping a history/record of your data usage policies and their validity dates so that, given a customers booking/purchase date/time, you can determine which data usage policy was in force at that booking/purchase date/time.
With BookingHawk.com, booking is a two-step process. The first step is that the payment is taken from the clients card by Stripe. When Stripe indicates that the payment was successful, BookingHawk.com saves the details and sends confirmation emails etc. Sometimes, it can happen that the second part of this process fails. That is, after payment has been taken from the card, BookingHawk.com fails to complete the booking for technical reasons. The end result is a payment with no corresponding booking/purchase. In such instances, BookingHawk.com identifies via an automated audit job these payments. BookingHawk.com then refunds these payments. BookingHawk.com does not reimburse the lost Stripe commission. This loss is absorbed by the business.
Images uploaded to BookingHawk.com system are stored on Cloudinary.com which BookingHawk.com uses as an asset host.
When you connect a Stripe account to BookingHawk.com, you are responsible for disconnecting it if/when you decide to cease using the services of BookingHawk.com
